These Terms & Conditions ("Terms") govern your access to and use of thesoftlands.com and related services (the "Service") provided by The Insights Loop Limited, trading as The Softlands ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.
1. Who we are
The Service is operated by The Insights Loop Limited, trading as The Softlands. References to "us" in these Terms mean The Insights Loop Limited.
2. Eligibility and accounts
The Service is intended for adults purchasing on behalf of children. You confirm you are of legal age in your jurisdiction and, where you act for a business, that you have authority to bind it. You are responsible for keeping your account credentials confidential and for all activity under your account.
3. Acceptable use
You must not misuse the Service. In particular you must not: (a) use it unlawfully, fraudulently or to send spam; (b) infringe intellectual property or privacy rights of others; (c) upload malware or attempt to interfere with the security or integrity of the Service; or (d) scrape, probe, or attempt to gain unauthorised access to any part of the Service.
4. Content you provide
You retain ownership of the names, descriptions and other inputs you submit. You grant us a worldwide, non-exclusive licence to host, process and use that content solely to provide and improve the Service. You confirm you have the rights to share any content you submit and that it does not infringe third-party rights.
5. Generated stories, images and audio
Outputs generated for you (stories, illustrations, audio, posters) are produced using AI models. Outputs may occasionally contain inaccuracies and are intended for entertainment, not for professional advice. You are responsible for reviewing outputs before sharing them. You must not use outputs to create unlawful, deceptive or harmful content, including content that infringes third-party rights, depicts real children inappropriately, or promotes hate, violence or self-harm. We reserve the right to filter, remove or refuse outputs, and to suspend accounts that repeatedly violate these rules.
6. Intellectual property
We and our licensors own the Service, including all software, designs, branding, character templates and other materials we provide. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service and the outputs created for you for personal, non-commercial enjoyment within your family. You may not resell, redistribute, or reverse engineer the Service.
7. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms and our Refund Policy.
8. Service availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free or available at all times. We may modify, suspend or discontinue parts of the Service at any time.
9. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied. Our aggregate liability for any claim arising from or related to the Service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, special or incidental damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability that cannot be excluded by law, including for fraud, death or personal injury caused by negligence.
10. Indemnity
You agree to indemnify us against any claims arising from your content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
11. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time. On termination, your right to use the Service ends; we may delete account data after a reasonable export window, subject to our retention obligations.
12. Changes to the Service or Terms
We may update these Terms from time to time. Material changes will be notified to you by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws of your country of residence apply.
